Terms of Service

These Terms of Service (“Terms”) govern access to and use of the products and services provided by ProQueue, Inc. (“Fleety,” “we,” “our,” or “us”), including our website(s), web applications, APIs, and integrations (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of a business, you represent that you have authority to bind that business, and “you” refers to that business.

01The Services

Fleety provides software tools for home-service businesses to manage and optimize dispatch, routing, scheduling, and customer communications, including AI-assisted call handling and appointment notifications.

We may modify, improve, or discontinue features of the Services from time to time. Where a change materially reduces core functionality your organization relies on, we will use reasonable efforts to provide advance notice.

02Accounts and Eligibility

You must provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

The Services are business tools intended for use by companies and their authorized personnel. You must be at least 18 years old to create an account.

Notify us promptly at support@usefleety.com if you suspect unauthorized use of your account.

03Acceptable Use

You agree not to:

  • Use the Services in violation of applicable law, including telemarketing, consumer-protection, and privacy laws
  • Send messages to consumers without the consent required by law and by our SMS Consent & Opt-In Policy
  • Interfere with or disrupt the integrity or performance of the Services
  • Attempt to gain unauthorized access to the Services or related systems
  • Reverse engineer, copy, resell, or sublicense the Services except as expressly permitted
  • Upload malicious code or use the Services to store or transmit unlawful material

04Customer Data

As between you and Fleety, you retain all rights to the data you or your end customers submit to the Services (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Services.

You are responsible for the accuracy and lawfulness of Customer Data and for obtaining any consents required to share it with us, including consumer contact information used for appointment notifications.

Our collection and use of information is described in our Privacy Policy.

Our commitments: we do not sell Customer Data, we do not use it for advertising, and we do not use it to train unrelated AI or machine-learning models.

05Third-Party Integrations

The Services interoperate with third-party platforms such as ServiceTitan, Housecall Pro, and Jobber. Your use of those platforms is governed by their own terms, and you are responsible for maintaining valid accounts and authorizations with them.

We are not responsible for the availability, accuracy, or performance of third-party platforms, or for changes to their APIs that affect integration functionality.

06Text Messaging (SMS)

Appointment-related text messages sent through the Services are governed by our SMS Consent & Opt-In Policy, which describes how consumer consent is collected, message types and frequency, and how recipients can opt out by replying STOP.

If your team collects consent on Fleety's behalf (for example, during booking calls), you agree to follow the disclosure process described in that policy.

07Fees and Payment

Fees for the Services are set out in your order form or subscription agreement with Fleety. Unless otherwise stated there, fees are billed in advance, are non-refundable, and do not include applicable taxes.

We may suspend access for accounts with overdue balances after reasonable notice.

08Intellectual Property

The Services, including all software, designs, and content provided by Fleety, are owned by ProQueue, Inc. and its licensors and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.

Feedback you provide about the Services may be used by us without restriction or obligation.

09Disclaimers

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Fleety provides scheduling and dispatch recommendations; you remain responsible for business decisions made using the Services.

10Limitation of Liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to these Terms or the Services.

Except for your payment obligations and either party's breach of the other's intellectual property rights, each party's total liability under these Terms is limited to the amounts paid by you to Fleety for the Services in the twelve (12) months preceding the event giving rise to the claim.

11Termination

You may stop using the Services at any time, subject to the terms of your subscription agreement. We may suspend or terminate access for material breach of these Terms that remains uncured after reasonable notice.

Upon termination, your right to use the Services ends. Provisions that by their nature should survive (including payment obligations, intellectual property, disclaimers, and limitations of liability) will survive.

12Changes to These Terms

We may update these Terms periodically. If we make changes, we will update the “Last updated” date above. Material changes will be communicated where required, and continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
